Overview of Factory License

A Factory License is a mandatory approval required for operating a factory in India under the provisions of the Factories Act, 1948. The main objective of obtaining a Factory License is to ensure the health, safety, welfare, and protection of workers employed in industrial establishments.

Before starting manufacturing activities, every eligible factory owner must register the factory premises with the concerned authorities and obtain approval for the factory building plan from the relevant Labour and Employment Department or state authority.

A Factory License serves as official permission granted by the competent authority to carry out manufacturing operations. The Department of Factories and Boilers (or the concerned state factory department) is responsible for issuing licenses, conducting inspections, and ensuring compliance with workplace safety standards.

Purpose of Factory License

The major objectives of Factory License registration are:

  • To ensure a safe and healthy working environment for employees.

  • To regulate manufacturing activities and factory operations.

  • To monitor compliance with health, safety, and welfare provisions.

  • To protect workers from workplace hazards and unsafe conditions.

Applicability of Factory License

The provisions of the Factories Act, 1948 generally apply to factories that:

  • Employ 10 or more workers and use electricity or power for manufacturing activities.

  • Employ 20 or more workers without using electricity or power for manufacturing activities.

Classification of Factories

Factories are broadly classified into two categories based on the nature of manufacturing activities:

1. Hazardous Factories

Factories involved in processes that may pose risks to workers' health, safety, or the environment due to the use of hazardous substances or activities.

2. Non-Hazardous Factories

Factories carrying out manufacturing activities that do not involve significant risks or hazardous processes as prescribed under applicable regulations.

Registration Procedure for Factory License in India

The Factory License Registration Process in India is governed by the provisions of the Factories Act, 1948. As per Section 6 of the Factories Act, 1948, the State Government is empowered to frame rules relating to the approval, registration, and licensing of factories.

Before commencing manufacturing activities, the factory owner must obtain approval for the factory building plan from the concerned authority. The procedure may vary depending on whether the factory falls under the category of hazardous or non-hazardous manufacturing activities.

Step 1: Submission of Factory Plan

The applicant must submit the factory building plan to the concerned State Government authority for approval before starting construction or manufacturing operations.

The plan should include:

  • Layout and details of factory premises

  • Manufacturing process details

  • Location and details of machinery

  • Safety arrangements and workplace facilities

Prior approval is required for the construction, extension, or modification of factory premises as per applicable state rules.

Step 2: Provide Factory Details

The applicant is required to provide details such as:

  • Name and address of the factory

  • Name and details of the factory owner

  • Name of the factory manager

  • Nature of manufacturing process

  • Number of workers employed

  • Details of machinery installed

Step 3: Filing of Application

After obtaining the required plan approval, the applicant must submit the Factory License Application in the prescribed form along with the required documents and declarations to the concerned Factory Department.

Step 4: Submission of Documents

The applicant must submit supporting documents including ownership details, factory layout plan, business constitution documents, machinery details, manufacturing process details, and other required approvals.

Step 5: Payment of Government Fees

After submission and acceptance of the application, the prescribed license fees must be paid to the concerned authority.

The Factory Inspector or authorised officer may inspect the factory premises to verify compliance with safety standards, worker welfare requirements, and applicable provisions of the Factories Act.

Step 7: Grant of Factory License

After successful verification of the application, documents, inspection report, and payment of applicable fees, the concerned authority issues the Factory License, allowing the applicant to legally carry out manufacturing activities.

Factory License Renewal

A Factory License is generally issued for a limited validity period and must be renewed before its expiry to continue manufacturing operations legally. The renewal process is similar to the initial registration process and requires submission of the prescribed forms, documents, and applicable renewal fees.

The commonly required documents for renewal of a Factory License include:

  • Form-4 (Application for renewal of factory license)

  • Form-4B

  • Treasury Challan or Online Fee Payment Receipt

  • Previous Factory License details

  • Other documents as required by the concerned Factory Department

Penalty for Late Renewal of Factory License

If the factory owner fails to renew the license within the prescribed time, a penalty may be imposed as per applicable state rules. Generally, the penalty may start from 10% of the applicable license fee and may increase for every month of delay.

Voluntary Suspension of Factory License

In certain situations, a factory owner may voluntarily surrender or suspend the Factory License. The applicant needs to follow the prescribed procedure with the concerned authority.

Procedure for Voluntary Suspension

Step 1: Submit Application for Suspension

The license holder must submit an application requesting suspension of the Factory License along with the reason for surrender or closure.

Step 2: Submit Required Documents

The applicant must attach supporting documents and details required by the authority.

Step 3: Provide Worker Details
